I sustained a burn injury at work – can I claim compensation?

2. Your employer breached this legal duty of care

3. In breaching this duty, they contributed to your injury

Proving that your employer owed you a duty of care is generally very straightforward. All employers are bound by common law to prevent their employees from coming to physical or psychological harm in the work place as far as is reasonably practicable. This means that health and safety laws must be respected, risk assessments must be carried out and effective safety measures must be taken to protect staff.

Proving that your employer breached their legal duty of care is more complicated but is well within the capabilities of a specialist work accident compensation claim solicitor. You must be able to prove that your employer did not take all reasonably practicable steps to avoid you coming to harm. In the cases of burn injuries this may mean failing to apply warning signs to hot machinery or to provide sufficient protective equipment to guard against burns.

Having proved the first two provisos, you must then prove that there was a causal link between the breach of duty and the injury itself. Therefore, if the employer identified in a risk assessment that warning signs should be placed on hot machines and then failed to act upon this or communicate it to staff, it would be an example of employer negligence.
