On this occasion we acted for a client who sustained an injury to his arm due to some blades on machinery in his factory being released and trapping his arm.

Our client worked in a factory that makes uPVC windows and doors. He was required to work on various items of machinery as part of his job, although he was not formally trained on any of the machinery.

On the day of the accident he was working on a piece of machinery that had two metal circular saw blades which move up and down the machinery on two metal rods. To operate the machinery two buttons must be pressed at the same time.

The machinery needed clearing of debris so one of our clients colleagues pressed both buttons to move the blades to the other end of the machine. The electricity was isolated from the blades so that they could not spin. However, our clients colleague let go of one of the buttons whilst our clients arm was in the machinery. This led to the two metal rods returning quickly to the front of the machine trapping and crushing our client's arm by the sharp metal blades of the circular saw. Our client pulled his arm away from the blades but sustained a deep cut just above the wrist and some other cuts on his forearm.

He also sustained bruising, abrasions, lacerations and swelling across the top of his arm. He immediately thought that he had broken his arm.

He was taken to hospital where he received stitches for his lacerations. Fortunately on examination it was discovered that his arm was not broken although it was severely swollen so he was supplied with a sling.

We obtained all evidence and proved that his employer had not provided the necessary treatmet. We are in the process completing the valuation of our client's claim prior to settlement.
