Our client worked in a factory making Belfast sinks. Part of his job involves cleaning out the machines which produce the liquid clay that is used to make the sinks. The machines are called Blungers and are suspended from the ceiling. Once the clay had been made and emptied out of the bottom of the machine, our client had to lean inside the machine to scrape off any clay that had stuck to the sides. Inside the machine there are four mixing blades.

On the day of the accident in the factory the clay had been emptied from the machine and our client leaned inside from the walkway to clean away the excess. In doing so he caught his index finger against a leading edge of one of the mixing blades which was very sharp. The cut went through to the bone.

He attended First Aid and then hospital. The bleeding could not be stopped so he was admitted as a Critical Injury patient. After an X-ray it was discovered that the laceration had cut through a tendon. The tendon was subsequently repaired under anaesthetic.

He was signed off work for six weeks.

We were able to establish that the blades that had caused the injury should have been replaced sometime before the accident, and if they had been they would not have been sharp enough to cause the injury. Therefore, our client’s employers admitted responsibility for the accident.
