Corporate Manslaughter Act 6th April 2008

On 6th April 2008 the Corporate Manslaughter Act came into force.
The new legislation applies to private and public companies and organisations including the police force and trade unions. It is designed to protect workers and to punish employers if they fail to meet stringent Health and Safety policies. It has been implemented following some high profile cases where employees have been killed and no action was able to be taken against the employers despite evidence of gross negligence.
Any employer now found guilty of gross negligence in the even of one of their employee's deaths will now be able to charged with corporate manslaughter. This can lead to an unlimited fine on the company, but also to the company having to publish details of their conviction. All employers should carry out a thorough review of their Health and Safety policy to ensure it meets the current best practice standards.
