How much compensation will I receive for a work accident claim?

Unfortunately there is no set answer to this question. The fact is that every work accident claim is different, and the sum of compensation will vary accordingly. At its most basic, a compensation settlement is intended firstly to recompense for the pain, suffering and loss of amenity (known as general damages), and to repair any financial losses you have incurred (known as special damages). To do so, a medical expert will be asked to examine you in person and prepare a written report upon your injuries. 2. Special damages: unlike general damages, your special damages are quantifiable. By this we mean that your solicitor will add up all the money you have lost because of your accident (such as loss of earnings and medical treatment) in a schedule of damages. This calculation is final and cannot be negotiated.

Your general damages and special damages will then be added together to make a settlement. Ordinarily this figure will be proposed to the other side in a Part 36 offer. The defendant party may then choose to accept the offer made by your solicitor, or may enter into negotiations.
