Government delays raising threshold on small claims court

At long last, some sense from the government when it comes to personal injury claims. After months when personal injury victims and their accident lawyers have been continually undermined, to the benefit of insurance companies, the government have at least agreed to delay until autumn this year their response to the recent consultation on raising the threshold of the small claims court.

Speaking last week at the conference organised by modern law, Helen grant, the justice minister, confirmed that the timetable for the consultation – telling delegates that the proposed reforms will leave the legal profession with “pain initially and uncertainty”.

Let’s hope, when the government finally comes round to making a decision on the issue, that they hold off undermining the legal rights of accident claim victims further by raising the threshold of the small claims court to £5000 – below which, it’s suggested that claimants would not be allowed to be recompense for their legal costs – effectively leading them unrepresented at the mercy of insurance companies, who you can bet your bottom dollar will remain represented by specialist accident solicitors.
